Terms and Conditions

Please read the following terms and conditions carefully. You must not make any booking unless you are 18 years of age or older and understand and agree with the following terms and conditions.

These terms and conditions apply to bookings you make with a Consultant ( over the phone or by email). These terms and conditions govern our relationship with you. Once we accept a booking from you on behalf of a Supplier, you will also have a separate contract with the Supplier, which will be governed by other terms and conditions. It is your responsibility to make yourself aware of those other terms and conditions.

Executive Summary

Although you should read all of the terms and conditions, the following is a summary of the most important:

  • Prices, including, in some cases, of confirmed bookings, may be subject to change.
  • Some confirmed bookings are non-refundable if cancelled by you and it is your responsibility to check if this applies.
  • We will be entitled to retain our service fees even if a booking is cancelled or does not proceed for any reason which is not our fault.
  • It is your responsibility to make yourself aware of all information relevant to your travel plans, including but not limited to visa requirements and health precautions.
  • We are not liable for the accuracy of any published Supplier content including websites and brochures.

Travel Advice including COVID-19 (Coronavirus) Guidance

We recommend that you contact the Department of Foreign Affairs and Trade (“DFAT”) or visit their website at https://www.smartraveller.gov.au for general travel advice, as well as specific advice (including safety alert levels) relating to the destination you wish to visit. You can also register your travel plans with DFAT, so that you may be more easily contacted in an emergency.

We strongly recommend that you familiarise yourself with the current status and updates to Australia’s immigration and border arrangements during the COVID-19 outbreak, available at https://covid19.homeaffairs.gov.au.

In addition you should familiarise yourself with airline requirements around passenger safety, including the requirement for face masks and the need to produce evidence meeting airline and border control requirements in relation to a negative COVID-19 test both for transit and final destination passengers. This information is subject to change without notice so we recommend you update yourself in relation to the relevant airline and government policies for your transit and final destination at each of (i) the time of booking, (ii) as you approach your travel date, and (iii) immediately before travel.

You acknowledge that you are choosing to travel at a time where you may be exposed to the Coronavirus. It is your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks. You acknowledge that your decision to travel is made based on your own consideration of this information, and you acknowledge and agree that you are aware of, and assume responsibility for, the risks associated with traveling at this time. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

Solo and Female only tours

All prices and tours are subject to available. Single supplement fee are only exempt from available tours with select tour groups. At The Sociable Traveller we do our best to match you with likeminded travelers, but do not hold responsibly for the passengers on your travel group. When you make a booking, you accept responsibility for the proper conduct of all members of your party during your travels with the Provider.

Prices

All prices are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed once your booking has been paid for in full by you. Please note that prices quoted are subject to change. Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Such factors include, but are not limited to, adverse currency fluctuations, fuel surcharges, taxes and airfare increases. Please contact your consultant for up-to-date prices.

Monies Not Held On Trust

You agree and acknowledge that such monies paid by you to us will not be held by us on trust for and on behalf of you and we may hold such monies in any account as we see fit, including with our own and/or other customer monies. All monies paid by you to us will be the property of The Sociable Traveller and will be a debt due and payable to the travel service provider in accordance with the payment terms we have agreed with that travel service provider. Payment will generally be made to the travel service provider before the services to which the money relates are provided, however in some cases, payment will be made to the travel service provider once the services to which the money relates have been provided. 

Passports & Visas

It is your responsibility to ensure you have the required documents before travelling to a destination. The Sociable Traveller may be able to assist with general enquiries but it is your responsibility to check, regardless of what you may be advised by us or others. You should assume that you will need a visa and we recommend that you make enquiry on the Smart traveller website. You will generally not be permitted to board plane/vessel unless you have a minimum of six months’ validity on your passport. Travel on a foreign passport may require a re-entry visa upon return to Australia. It is your responsibility to inform us if you have or expect passport or visa difficulty.

Governing Law

If any dispute arises between you and us, the laws applicable in WA will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of WA, and waive any right that you may have to object to an action being brought in those courts.

Your Responsibility

You are responsible for checking the accuracy of all documents provided to you and all booking information provided by you to The Sociable Traveller. We recommend that you cross reference your booking information with your passports.

Force Majeure

Travel can be impacted by events and circumstances beyond the control of The Sociable Traveller. The Sociable Traveller will not be liable for any costs, expenses, loss, liability, damage, injury or death which you incur arising out of or caused by events beyond the control of The Sociable Traveller including without limitation weather events, strikes, accidents, war or terrorism, civil or military disturbances, Pandemics or Acts of God. The Sociable Traveller will not be required to refund any monies paid by you to The Sociable Traveller in respect of travel services even when any of the force majeure events described in this clause occur. You bear the risk of those events.

Change and Cancellation Fees

Be aware that some confirmed bookings are not refundable if cancelled, and also may not be transferable to another date or otherwise changed. Alternatively, a change may only be permissible subject to payment of an additional fee or charge. It is your responsibility to check if a booking is non-refundable or will incur charges for changing it before placing the booking.

Changes and cancellations of confirmed bookings may incur fees from Suppliers in addition to our service fees. Suppliers’ fees are outlined in their relevant terms and conditions.

Refunds

Your entitlement to a refund for cancelled bookings is subject to the relevant Supplier’s terms and conditions.

If you are entitled to a refund then, subject to the Supplier’s terms and conditions, we will arrange for it to be supplied to us on your behalf, unless we expressly agree with you otherwise.

If we are managing or arranging a refund for a cancelled booking on your behalf it will not be paid to you until the Supplier provides the refund to us, and we will not be liable for any delay on the part of the Supplier. Be aware that typically airlines will take between 60-90 days to process a refund.

Please note that if we are entitled to a service fee for placing a booking, we will remain entitled to this fee if you cancel the booking or the Supplier fails to provide you with the Product for any reason (other than our default), including in an event of Force Majeure. We will be entitled to deduct our service fee from any refund we receive on your behalf before remitting the balance to you.

Deposits and Payments

You will be required to pay a deposit (or deposits) when booking. The deposit amount varies depending on the Product booked and lead time to travel. In some instances, full payment is required at the time of booking and your Consultant will advise the deposit amount at the time of booking. All deposits are non-refundable for changes of mind or cancellations by you (subject to your rights under the Australian Consumer Law). Where a deposit has been collected, final payment is required no later than six weeks prior to departure. Failure to make payment by the due date may result in your booking being cancelled and deposits forfeited.

Payments made by direct deposit may take up to three business days to process. If you are paying by this method, you will need to make the payment at least three business days prior to the actual due date. You must notify your Consultant of your payment once it has been made.

Credit card surcharges will apply when paying by credit card.
We accept all credit cards and relevant credit card fee is applied when processing:

Mastercard – 1.3%
Visa – 1.5%
American Express – 1.8%
Diners Card – 2.5%
International Credit Cards – 3%

Travel Insurance

We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. Your insurance protection should at least include cover for cancellation, medical and repatriation expenses, personal injury and accident, death and loss of personal baggage and money and personal liability insurance. Evidence of such insurances should be produced to The Sociable Traveller on request. Insurance cover offered by credit card companies or reciprocal medical cover agreements are often not comprehensive. Travel insurance is strongly recommended by the Department of Foreign Affairs and Trade for all overseas travel. Your travel consultant can provide general information to you about travel insurance.

We are an authorised representative of CoverMore Insurance Services Pty Ltd (ABN 95 003 114 145) (“CoverMore”) and receive financial and non-financial benefits when you buy CoverMore travel insurance products through us. We and CoverMore are authorised to provide you with general advice about, and arrange, travel insurance products on behalf of the insurer, Zurich Australian Insurance Limited (ABN 13 000 296 640, AFSL 232507).

You must read the CoverMore Combined FSG/PDS before you decide to buy the CoverMore travel insurance product you are considering purchasing to ensure it meets your needs and financial situation. The Combined FSG/PDS also contains information about the conditions, limits and exclusions that apply to the insurance, the 15 working day cooling-off period, and how you can access Cover-More’s privacy policy and complaints handling procedures.
If you make a travel booking through us and decline travel insurance, you may be required to sign a disclaimer.
